Promotion and demotion of SCs and STs

The Supreme Court in Special Leave Petition (Civil) No.30621/2011 has passed the following order on 17.5.2018:-

“It is directed that the pendency of this Special Leave Petition shall not stand in the way of Union of India taking steps for the purpose of promotion from ‘reserved to reserved’ and ‘unreserved to unreserved’ and also in the matter of promotion on merits..”.

Further, in the matter related to Special Leave Petition (Civil) No.31288/2017 connected to Special Leave to Appeal (Civil) No.28306/2017, the Supreme Court held as under  on 05.06.2018:-

“Heard learned counsel for the parties, Learned ASG has referred to order dated 17.05.2018 in SLP(C) No.30621/2011. It is made clear that the Union of India is not debarred from making promotions in accordance with law, subject to further orders, pending further consideration of the matter. Tag to SLP (C) No.30621 of 2011.”

Based on interim Orders/directions of the Supreme Court dated 17.05.2018 and 05.6.2018, Department of Personnel and Training vide Office Memorandum No. 36012/11/2016- Estt.(Res-I) {Pt-II} dated 15.06.2018 requested all the Ministries/Departments of the Government of India to carry out promotions in accordance with above directions of the Supreme Court on existing seniority / select lists subject to further orders which may be passed by the  Supreme Court. The State Governments were advised to take necessary action in accordance with the above-mentioned orders passed by the Supreme Court.

The respective cadre controlling authorities carry out promotions and data on persons promoted, etc. are maintained by them.

Shri Piyush Goyal Approves a New Promotion Policy for Railway Sportspersons

Railway Sportsperson & Coaches will be promoted to the Officer Rank

Union Minister of Railways, Coal, Finance & Corporate Affairs, Shri Piyush Goyal has approved a new policy for promotion of Railway Sportspersons whereby in addition to the sportspersons who won a position/medal in Olympics, all those sportspersons & coaches who have been awarded with Padma Shri will be promoted as officers.

In order to give due recognition to the effort put in by the sportspersons, who have made two appearances in Olympics, won a medal in Asian Games/Common Wealth Games, it has now been decided to award them with a promotion to the officer rank. Further Railway sportsperson who are winners of any of the awards like Arjuna/Rajiv Gandhi Khel Ratna Award would also be entitled to the said promotion.

The contribution of the coaches to the successful performance of sportspersons has been duly acknowledged & any coach whose trainees have produced at least three medal winning performances in Olympic Games / World Cup / World Championship / Asian Games / Commonwealth Games including at least one medal in Olympic Games would be eligible to be promoted as an Officer.

This liberalized promotion policy will act as an incentive to the country’s elite sportspersons/coaches and reaffirms Railways commitment to the promotion of sports in the country.”

In April 2018, during the felicitation function organized by Railway Sports Promotion Board for the medal winners of CWG 2018; at National Rail Museum, Shri Piyush Goyal had announced that Railways would soon come up with a promotion policy to address the legitimate aspirations of the outstanding Railway athletes; whereby not just medals but the effort put in by sportspersons would also be acknowledged. The Minister had also emphasized the role of coaches in producing successful sportspersons.


Identification of Beneficiaries Without Aadhaar

As per section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016, any individual who is desirous of availing any subsidy, benefit or service for which the expenditure is incurred from the Consolidated Fund of India, shall require to furnish proof of possession of Aadhaar number or undergo Aadhaar based authentication. In case the individual does not have Aadhaar, he/she shall make an application for enrolment and the individual shall be offered alternate and viable means of identification for delivery of the subsidy, benefit or service.

The notifications issued under section 7 of the Aadhaar Act, 2016 by the Ministry also provide mechanism to handle such cases where Aadhaar number is not assigned to an individual and instruct implementing agencies to deliver benefits on the basis of alternate identity documents.

Cabinet Secretariat (DBT Mission) Govt. of India had issued a circular dated 19.12.2017 regarding “Use of Aadhaar in Benefit Schemes of Government – Exception Handling, which inter-alia, stipulated mechanism in cases where Aadhaar authentication fails.

Till the time Aadhaar is assigned to the individual, subsidies, benefits or services under the schemes notified under Section 7 of Aadhaar Act, 2016 shall be given to such individuals subject to the production of the following documents:

  1. Bank Passbook of applicant in his or her name or jointly held with his or her parent or guardian, and which contains the photograph of the applicant;
  2. if he has enrolled, his Aadhaar Enrolment ID slip; or
  3. a copy of his request made for Aadhaar enrolment

Identity proofs as under––

  1. Voter identity card issued by the Election Commission of India; or
  2. Permanent Account Number (PAN) Card issued by the Income Tax Department; or
  3. Passport; or
  4. Driving licence issued by the Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988); or
  5. Certificate of identity having photo of such member issued by a Gazetted Officer or a Tehsildar on an official letter head; or
  6. Any other document specified by the State Government

Difference in Income Limit for Availing OBC Scholarships

Welfare Schemes for OBCs/EBCs/DNTs are funds limited and there is a huge demand from the States. To award scholarship to the most needy students, the income ceiling have been fixed accordingly.

The details of income limit for parents of OBC and other students in the following schemes implemented by the Ministry of Social Justice and Empowerment are as under:

There is a proposal under examination for enhancement of income ceiling for parents under the Centrally Sponsored Scheme of Post-Matric Scholarship for OBC Students in India from Rs. 1.00 lakh to Rs. 1.50 lakh.

No Proposal for Removal of Creamy Layer for OBCs

The Government has implemented the ‘creamy layer’ concept in pursuance of the Hon’ble Supreme Court’s order in the case of Indra Sawhney and others etc. vs. Union of India and others [(Civil) No. 930/1990]. At present, there is no proposal in the Ministry of Social Justice and Empowerment for removal of Creamy Layer.

The Government has constituted a Commission on 2nd October, 2017 under article 340 of the Constitution to examine the sub-categorization of Other Backward Classes.  The Commission commenced functioning with effect from 11.10.2017 i.e. the date of assumption of charge by the Chairperson. There has been no delay in constituting the panel.

Certain States including Andhra Pradesh and Telangana have introduced sub-categorization within Other Backward Classes reservation quota.  The sub-categorization adopted by these States is being studied by the Commission for Other Backward Classes to examine the issues of sub-categorization of Other Backward Classes in the Central List.

Schemes for Welfare of Weavers

Ministry of Textiles is implementing various schemes for welfare of weavers and development of handloom sector across the country. The schemes are Handloom Weavers’ Comprehensive Welfare Scheme (HWCWS), National Handloom Development Programme (NHDP), Yarn Supply Scheme (YSS) and Comprehensive Handloom Cluster Development Scheme (CHCDS) for eight mega handloom clusters in the country.

Under these schemes, financial assistance is provided for raw materials, purchase of looms and accessories, design innovation, product diversification, infrastructure development, skill upgradation, marketing of handloom products and loan at concessional rates. Besides, the Government of India has reserved 11 textiles articles, including sarees with technical specifications for exclusive production by handlooms under The Handlooms (Reservation of Articles for production) Act, 1985. Balaramapuram sarees from Kerala has also been registered under Geographical Indications Act. Five block level clusters, including Kollayil Cluster, Thiruvananthapuram district, have been sanctioned with a total project cost of Rs. 8.86 crore with Government of India share of Rs. 8.63 crore and released Rs. 2.77 crore as first instalment.

In order to address the health related issues of handloom weavers of the country, including weavers of Balaramapuram, Ministry of Textiles has been implementing Handloom Weavers’ Comprehensive Welfare Scheme. Life insurance cover to handloom weavers and workers in the age group of 18-50 year is provided under Pradhan Mantri Jivan Jyoti Bima Yojana (PMJJBY) and accidental insurance cover to handloom weavers and workers in the age group of 18-50 years is provided under Pradhan Mantri Suraksha Bima Yojana. Closed group of handloom weavers in the age group of 51-59 years, which are already enrolled as on 31.05.2017 under the Mahatma Gandhi Bunkar Bima Yojana (MGBBY) will continue to get cover under the converged MGBBY. The benefits of schemes are available to all the handloom weavers, including widowed weavers. Also, scholarship of Rs. 1200 per year per child upto 2 children is also provided to the handloom weavers.

Credit requirements of handloom weavers are met under Weavers’ MUDRA scheme, a component of NHDP. Under the scheme, credit is provided at concessional interest rate of 6% to the handloom weavers with margin money assistance upto Rs. 10,000 per weaver and credit guarantee for a period of 3 years. In Kerala, 324 weavers have been sanctioned Mudra loan worth Rs. 1.61 crore in last three years.

In order to attract younger generation into the handloom profession, provision has been made under NHDP for skill upgradation. An MoU has been signed with NIFT, New Delhi to promote handlooms through fashion by introducing handlooms in the course curriculum of Under-Graduate and Post-Graduate courses from academic session 2016-17.

During 7-17th October 2017 and 19-24th February 2018, total 305 Hastkala Sahyog Shivirs, including 9 Shivirs in Kerala were organised in various handloom clusters to facilitate the handloom weavers for obtaining MUDRA loan, yarn passbooks, looms & accessories, enrol for NIOS and IGNOU courses.

Reshuffle of IAS officers in UP

Around half a dozen IAS officers have been transferred and posted to different places in Uttar Pradesh. Accordingly Masoom Ali Sarwar has been appointed as Director, Panchayati Raj  while Rajendra Kumar Singh is Special Secretary, Child Development and Nutrition and Mrs Aradhana Shukla is  Special Work Officer, NOIDA. Similarly Rajesh Prakash has been assigned  as Additional Resident Commissioner charge; A Dinesh Kumar as Special Secretary, Science and Technology and Sanjiv Ranjan  was posted as CEO, Gorakhpur Industrial Development Authority.
